The two documents serve different estate-transfer purposes and should not be treated as interchangeable. NADRA’s current guidance expressly identifies Succession Certificates for movable properties and Letters of Administration for immovable properties. This distinction matters when legal heirs are dealing with bank balances, shares, securities, land, houses, plots or other estate assets.

Who Can Apply Through NADRA for Succession Documents?

NADRA Eligibility for Legal Heirs in Pakistan

NADRA states that the deceased and the legal heirs must be Pakistani citizens and that the property or assets must be located in Pakistan. One legal heir attends the designated NADRA location after completing the required documentation. NADRA’s current guidance also carries a province-specific note that applications are handled through legal counsel in Sindh and Balochistan only; applicants in those provinces should follow the current procedure displayed by NADRA.

The Family Registration Certificate is central to NADRA’s identity and family-composition verification, but an FRC should not be treated as a substitute for a legal opinion where heirship, personal law, disputed relationships, exclusions, minors or inheritance shares require closer examination.

  • Death Certificate of the deceased;
  • CNIC Cancellation Certificate issued by NADRA;

  • details of the movable and immovable property involved; and
  • Letter of Authorization/Affidavit attested by an Oath Commissioner.

Additional records may be needed in practice depending on the asset. Banks may require account or balance information, companies may require shareholding records, and property authorities may require title documents, allotment letters, leases, mutation records or other ownership evidence.

How the NADRA Succession Process Works

Application, Heir Verification, Publication and Issuance

NADRA’s current succession service is designed for eligible legal heirs seeking an administrative route. The applicant provides the required documents and estate details, NADRA verifies family information and legal-heir data, the prescribed public-notice process is completed, and the legal heirs complete the required identity or biometric formalities. NADRA states a processing time of 14 days after publication. That figure should not be read as a guarantee that every estate will be completed within 14 calendar days from the first consultation, because document preparation, corrections, objections, verification issues or a decline can extend the overall matter.

The old advice that succession matters never require court proceedings is no longer appropriate as a blanket statement. The correct route depends on the applicable federal or provincial succession law, the nature of the estate and whether factual or legal issues require adjudication.

When Is a Court Succession Petition Required?

NADRA Decline, Disputed Heirship and Matters Requiring Adjudication

The NADRA route does not eliminate the judicial route. Depending on the applicable succession legislation, a court may become the proper forum where NADRA declines to process the application or where the matter requires adjudication. Examples can include objections, disputed heirship, conflicting family records, questions requiring evidence, challenges to an earlier grant, or other factual controversies governed by the relevant law.

For court-issued succession certificates, the Succession Act, 1925 remains an important procedural statute. Sections 371 and 372 address jurisdiction and the application by petition. The correct court, pleadings and supporting evidence should be determined from the facts of the estate and the governing provincial or federal framework rather than from a generic online checklist.

Why Identifying Heirs Is Different from Calculating Shares

A succession application must correctly identify every legal heir. For Muslim estates, shares are governed by applicable Muslim personal law and the precise family structure at the date of death. A spouse, sons, daughters, parents and other relatives can affect one another’s shares. The existence of a name on an FRC does not by itself answer every inheritance-law question, and the omission or incorrect inclusion of an heir can create serious consequences.

Succession for Overseas Pakistani Legal Heirs

Handling Heirs Who Are Outside Pakistan

Many Pakistani estates involve heirs living in the United Kingdom, United States, Canada, the Gulf or elsewhere. Overseas residence does not automatically remove an heir from the estate. Identity verification, authorization, document attestation and appearance requirements should be planned according to the current NADRA or court procedure applicable to that case. Older internet pages often contain fixed lists of foreign biometric locations; those lists should not be relied upon without checking current official arrangements.
